IMPORTANT-READ CAREFULLY. This End-User License Agreement ("EULA") is a legal AGREEMENT between you and Engineering Optimization Software products, which product includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT"). By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, then DO NOT install or use the SOFTWARE PRODUCT; in such event the original purchaser or unregisterd END-USER may, however, remove the above SOFTWARE PRODUCT and/or its components from the computer. SOFTWARE PRODUCT LICENSE

1) GRANT OF LICENSE.
The SOFTWARE PRODUCT is licensed, not sold. This EULA grants you the following rights:

The Single-User Licensed SOFTWARE PRODUCT may be used only by you. You may install and use one copy of the SOFTWARE PRODUCT, or any prior version thereof for the same operating system, on a single computer or of appropriate licensing.

The Educational Licensed SOFTWARE PRODUCT may be used only by the educational institution acquiring the software. It may be installed and used on any number of PCs within a department of the educational Institution.

The Commercial Licensed SOFTWARE PRODUCT may be used only by an Organization/Company acquiring the software. It may be installed and used on any number of PCs within the Organization acquiring the software.

2) OTHER RIGHTS AND LIMITATIONS.
a· Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not modify, reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT for any reason. The SOFTWARE PRODUCT is licensed as a single product. This SOFTWARE PRODUCT can be Installed on computer as a whole and shall not be seperated in parts or disassembled to part or pieces.

b· Not for Resale Software. This SOFTWARE PRODUCT is labelled "Not for Resale" or "NFR" or "Evaluation Copy". You may not use the SOFTWARE PRODUCT for buisness purposes nor sell, or otherwise transfer it for value as money or any other form of consideration(s).

c· Rental. You may not rent, lease, or lend the SOFTWARE PRODUCT to any party.

d· Termination. Engineering Optimization Software may terminate this EULA if you fail to comply/agree with the terms and conditions of this EULA. In such event, you must destroy any and all copies of the SOFTWARE PRODUCT and all of its component parts and/or its contents.

3) UPGRADES.
If the SOFTWARE PRODUCT is labelled or otherwise identified by Engineering Optimization Software as an "upgrade", you must be properly licensed to use the product. A registered End-User is eligible or licensed for the upgrade in order to use the SOFTWARE PRODUCT. You may use the resulting upgraded product only in accordance with the terms of this EULA. This SOFTWARE PRODUCT's upgrade/update may subject to changes in terms of payment i.e an additional amount may be charged for an upgrade/ update for the registered End-User.

5) RECEIVE MODE OF SOFTWARE.
You may receive the SOFTWARE PRODUCT in more than one medium/mode. Regardless of the type or size of the medium you receive, you may use only that one medium that is appropriate for your computer. You may not use or install the SOFTWARE PRODUCT's other medium on another computer, You may not loan, rent, lease, or otherwise transfer the other medium to another user.

6) MISCELLANEOUS.
This EULA Should/must be accepted by you if you want to install the SOFTWARE PRODUCT on the computer. If you have any questions please contact us at: sales@planopt.com

8) LIMITATION OF LIABILITY.
Engineering Optimization Software shall not be held liable in anyway for any loss of trade or time occurring to the customer in the event of delivery of goods being delayed by reason of accidents, restraints of governments, debugging and personalizing the software for the customer by the developers or any other causes not within reasonable control.

Worldwide rights of ownership and distribution of the above-mentioned software(s) rest with Engineering Optimization Software, 1386 Pritchett Industrial Drive, Austell, GA 30168, United States of America. The software(s) quoted above and associated documentation are proprietary products. Unlicensed use of the program or reproduction in any form or by any means, without prior written permission from Engineering Optimization Software is explicitly prohibited.

The computer program FEMBUS/VIP-PLANOPT is distributed on "as is" basis. No warranty is expressed or implied by the developers or the distributors on the accuracy or the reliability of the program. The authors and the distributors hereby disclaim any liability to any party for any loss or damage resulting from the installation or use of this program. Engineering Optimization Software makes no representations or warranties and specifically disclaims any implied warranties of merchantability or fitness for any particular purpose.

IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT DELETE/REMOVE THE SOFTWARE AND ITS CONTENTS FROM ALL STORAGE MEDIA AND DO NOT INSTALL/USE THIS SOFTWARE PRODUCT.
